End User License Agreement

1. Software Owner / Licensor
This End User License Agreement (“EULA”) is entered into between:

and the end user (“Licensee”).
By installing, copying, accessing, or using the Next Dashboard software, including its related plugins, applications, media libraries, tools, and accessory files, and, where requested, by expressly accepting this EULA, the Licensee agrees to be bound by its terms. If the Licensee does not agree to these terms, the software must not be installed or used.
2. Scope of the license and third-party dependencies
This EULA governs the use of the following software and content, collectively referred to as the “Software”:
Next Dashboard, including its related plugins, applications, and accessory files, such as Next Plugin
The built-in video library, proprietary dashboard layouts, graphic assets, and other content supplied by the Licensor
Any related updates, patches, optional components, tools, or associated content provided by the Licensor
2.1. Mandatory third-party software dependency
The Software is not a standalone program, but operates exclusively as an extension (plug-in) and is strictly dependent on the prior installation, configuration, and correct operation of the third-party software SimHub. The Licensee is solely responsible for verifying the compatibility of their own system before use.
2.2. Statement of non-affiliation
The Licensor is a completely independent project and is in no way affiliated, associated, sponsored, authorized, or officially connected with the developer of SimHub or with its registered trademarks. The Licensee is required to obtain, install, and license the SimHub software entirely independently through the official channels of its respective manufacturer. The proprietary portions of the Software are protected by Italian and international copyright and intellectual property laws.
2.3 Third-party software and licenses
The Software may include, distribute, invoke, or interoperate with software, libraries, codecs, tools, or services owned by third parties. Those components remain the property of their respective owners and are governed by their applicable license terms. This EULA does not restrict any right granted under an applicable third-party license and does not transfer ownership of any third-party component to the Licensor.
3. Grant of license
The Licensor grants the Licensee a license that is:
Tied to the Licensee's unified Next Sim Racing profile
Non-exclusive
Non-transferable
Revocable in accordance with this EULA and mandatory applicable law
Limited to the rights expressly granted under this EULA
The purchase, activation, or download of the Software does not entail the sale or transfer of ownership of the Software, but only the granting of a right of use for personal or commercial purposes, solely in accordance with this EULA and the applicable Terms and Conditions of Sale. The features available to the Licensee depend on the active access plan. Commercial use does not include resale, sublicensing, account sharing, multi-user access, or simultaneous use on multiple devices unless expressly authorized in writing by the Licensor.
4. Account, authentication, and profile linking
Access to the Software and to features linked to a license requires a unified Next Sim Racing profile. Depending on the authentication methods made available by the Licensor, the Licensee may authenticate through passwordless email verification using a one-time password (“OTP”), Discord, Steam, or another expressly supported method.
Email, Discord, and Steam identities may be linked to the same unified profile. Each third-party identity may be associated with only one Next Sim Racing profile. The Licensee may connect or disconnect supported identities through the account area where the relevant function is available, provided that at least one valid authentication method remains linked to the profile.
The license is indivisible and strictly bound to the unified profile. The Licensee is solely responsible for maintaining access to their email account and linked third-party accounts, for keeping OTP codes and active sessions confidential, and for all activity carried out through their profile. OTP codes must not be disclosed to third parties.
The Licensor is not responsible for penalties, restrictions, suspensions, bans, outages, or changes applied by Discord, Steam, email providers, or other third-party authentication providers. The availability of a particular authentication method may depend on the continuing availability and technical requirements of the relevant provider.
5. Devices and simultaneous use limitations
The Licensee may install the Software on an unlimited number of computers. However, the license, whether free or paid, permits use of the Software on only one device at a time. The Licensee may change the computer in use without a fixed transfer limit, but simultaneous use on multiple machines is strictly prohibited. When the Software is activated on another device, an existing Software session may be ended or invalidated.
Sharing the account, authentication methods, OTP codes, active sessions, or license with third parties is strictly prohibited. Any attempt to bypass technical limitations relating to device use, session control, or license verification constitutes a material violation of this EULA.
6. License restrictions and prohibitions
Except to the extent expressly permitted by mandatory applicable law or by an applicable third-party license, the following actions are strictly prohibited:
Copying, distributing, selling, renting, sharing, or sublicensing the proprietary Software or installer to third parties, whether free of charge or for payment
Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or internal structure of the proprietary portions of the Software
Modifying, altering, translating, or creating derivative works based on the proprietary portions of the Software
Copying, reproducing, duplicating, extracting, or cloning the dashboard graphic files, built-in videos, or other proprietary assets beyond the use expressly permitted by the license
Removing, obscuring, or altering trademarks, copyright notices, license notices, attribution notices, or credits present within the Software
Bypassing or attempting to bypass licensing, authentication, integrity verification, signatures, hashes, session controls, or other protection systems
Using the Software for illegal, fraudulent, abusive, or unauthorized purposes
Nothing in this Section prevents the Licensee from making necessary backup copies of their own exported configurations, observing or testing the functioning of the Software, or performing acts required for interoperability, but only where and to the extent such acts are expressly permitted by mandatory applicable law. Restrictions relating to third-party components apply only as provided by the applicable third-party licenses.
7. Intellectual property rights
All intellectual, industrial, and copyright rights relating to the proprietary portions of the Next Sim Racing ecosystem belong exclusively to the Licensor and are protected by applicable laws. This protection includes the Licensor’s source code, architecture, digital files, logical structure, visual design, graphic layouts, built-in media, and the trademarks or names “Next Sim Racing”, “Next Dashboard”, and “Next Plugin”. Nothing in this EULA grants the Licensee any ownership rights over the Software or its proprietary assets. All product names, simulator logos, and third-party trademarks, including Assetto Corsa, iRacing, rFactor, Le Mans Ultimate, F1, SimHub, Discord, Steam, and FFmpeg, belong to their respective lawful owners. Their use by the Licensor is for descriptive, compatibility, attribution, and informational purposes only and does not imply affiliation, endorsement, sponsorship, or official connection.
7.1 Built-in media
The built-in media is licensed only for display and use through the Software in accordance with the active access plan. The Licensee may not extract, redistribute, publish, sell, sublicense, separately reuse, or make the built-in videos or other media available as standalone files.
8. Updates and software modifications
The Licensor may provide updates, modifications, corrections, security fixes, compatibility updates, or improvements through the Licensor’s servers. Dashboard, Plugin, Videos, Tools, and other components may be technically separate, but the updater may install all applicable available updates within the same update procedure. Individual installation of only some available updates may not be supported.
Updates may be installed automatically or manually and may require the Software, SimHub, or related processes to be restarted. Optional components may already be included by the installer or may be offered and installed when a related feature requires them.
The Licensor may use digital signatures, hashes, file-integrity checks, or similar mechanisms to verify the authenticity and integrity of Software components. If an update fails, the updater may preserve or restore the last valid installation; however, the Licensee remains responsible for maintaining backups of their own configurations and custom files.
The Licensee acknowledges that failure to install updates may result in malfunctions, security risks, incompatibility with SimHub, simulators, Windows, hardware, or interruption of online services. Subject to mandatory consumer rights, the Licensor does not guarantee continued operation or support of obsolete versions.
8.1 Modifications affecting consumers
Where the Software or a digital service is supplied to a Consumer over a period of time, modifications beyond those necessary to maintain conformity, security, or compatibility will be made only for a valid reason, without additional cost to the Consumer, and in accordance with mandatory applicable law. Where a modification negatively affects access to or use of the Software in more than a minor manner, the Consumer will receive clear advance information on a durable medium and may exercise any termination or other remedy provided by mandatory law.
9. Access plans, license verification, and suspension
The Software offers different access plans, including the Free Plan and the paid Rookie and Pro Plans. The specific features, limitations, pricing, and billing conditions applicable to each plan are described on the official website and in the Terms and Conditions of Sale.
The Software requires periodic online verification of the profile, license status, active plan, and permitted device session through the Licensor’s servers. Permanent offline use is not guaranteed. In the event of temporary server unavailability, the Software may continue to function for a limited tolerance period, which may vary according to the version, security requirements, and technical conditions.
The Licensor may temporarily suspend online access or paid features where reasonably necessary because license verification is unavailable, a security risk is detected, fraud or unauthorized use is suspected, a material breach of this EULA has occurred, or suspension is required by law. Where reasonably possible and legally appropriate, the Licensor will provide notice and an opportunity to remedy the issue.
If a paid subscription expires, is cancelled, or ends following unsuccessful payment recovery, access to paid features will end and the Software may revert to the Free Plan. Billing, renewal, cancellation, refunds, and withdrawal rights are governed by the Terms and Conditions of Sale and mandatory applicable law.
10. Termination, revocation, and account deletion
This EULA remains in effect until terminated. The Licensee may stop using the Software at any time by uninstalling it. Uninstalling the Software does not by itself delete the Licensee’s Next Sim Racing profile or cancel a paid subscription.
The Licensee may request deletion of their profile through the account procedure made available by the Licensor. Account deletion is permanent and results in the immediate revocation of active Software sessions and access rights linked to the profile. Local configuration or custom-media files may remain on the Licensee’s device until manually deleted, but they will not preserve access to functions requiring an active profile or license verification.
Cancellation of a subscription and deletion of the profile are separate actions. Deleting a profile does not automatically create a right to a refund and may cause immediate loss of access to a remaining paid period where the deletion procedure expressly discloses that consequence. This does not limit any mandatory right of withdrawal, refund, conformity, or reimbursement available to a Consumer under applicable law.
The Licensor may suspend, revoke, or terminate a license in the event of a material violation of this EULA, fraudulent or unauthorized use, account sharing, chargeback abuse, or attempts to bypass the licensing or protection systems. Except where immediate action is reasonably necessary for security, fraud prevention, or legal compliance, the Licensor will act proportionately and, where appropriate, provide notice and an opportunity to remedy the breach.
The statutory 14-day right of withdrawal, where applicable to a Licensee acting as a Consumer, is governed by Section 11 of the Terms and Conditions of Sale. It does not apply to Licensees acting for purposes related to their trade, business, craft, or profession unless the Terms expressly provide otherwise. Upon termination or revocation, the Licensee must immediately cease all unauthorized use of the Software.
11. Statutory consumer rights and disclaimer of warranty
Save for the mandatory limits provided by law, the software is provided “AS IS”, without any express or implied warranties of any kind. The Licensor does not guarantee that the software is error-free, operates without interruptions, or is compatible with all hardware or software configurations.
The Licensor accepts no liability whatsoever and grants no refunds for malfunctions, service interruptions, or incompatibilities arising from:
Updates, changes, or bugs in the third-party software SimHub
Updates or changes released by the developers of individual driving simulators
Incompatibilities arising with future versions of the Windows operating system
11.1 Statutory consumer rights and conformity
Where the Licensee qualifies as a Consumer, nothing in this EULA excludes, restricts, or modifies the mandatory statutory rights applicable to digital content and digital services. These rights may include the right to receive the Software in conformity with the contract, necessary updates including security updates, restoration of conformity, a proportionate price reduction, termination of the contract, and reimbursement where the conditions established by applicable law are met.
11.2 Disclaimer of warranty
Subject to Section 11.1 and to the maximum extent permitted by law, the Software is provided “AS IS” and “AS AVAILABLE”, without additional express or implied warranties beyond those that cannot lawfully be excluded. The Licensor does not guarantee that the Software will be entirely error-free, operate without interruption, or be compatible with every hardware, software, simulator, telemetry source, or peripheral configuration. The Licensor is not responsible for malfunctions, interruptions, or incompatibilities caused exclusively by circumstances outside its reasonable control, including:
Updates, changes, outages, configuration errors, or bugs in SimHub
Updates or changes released by the developers of individual driving simulators
Changes to telemetry formats, APIs, or third-party authentication services
Incompatibilities introduced by future versions of Windows, drivers, firmware, or third-party hardware
Unauthorized modifications, unsupported configurations, or failure to install required updates
This disclaimer does not apply where the relevant malfunction or lack of conformity is attributable to the Licensor under mandatory applicable law.
12. Limitation of liability and hardware exclusion
To the maximum extent permitted by law, the Licensor shall not be liable for indirect, incidental, special, or consequential losses, loss of profits, loss of business opportunity, gameplay interruption, or loss of data or configurations arising from the use of or inability to use the Software. The Licensee is responsible for maintaining appropriate backups of configurations and custom files.
Nothing in this EULA excludes or limits liability that cannot lawfully be excluded or limited, including liability for willful misconduct or gross negligence, fraud, death or personal injury caused by negligence where applicable, breach of mandatory consumer rights, or any other liability that mandatory law requires the Licensor to bear.
12.1. Exclusion of liability for third-party peripherals and hardware
The Software processes and displays telemetry data sent by simulators and SimHub. The Licensor is not responsible for damage, wear, overheating, or malfunction of third-party peripherals or hardware where such consequences are caused by incorrect user configuration, operation outside manufacturer specifications, defective cabling or power supply, unsupported firmware, faults in SimHub or third-party drivers, unauthorized modifications, or other circumstances not attributable to the Software.
The Licensee is responsible for correctly configuring displays, Direct Drive bases, wheels with integrated screens, vibration or bass-shaker systems, LED indicators, and other peripherals within SimHub and for complying with the operating limits and safety instructions specified by their respective manufacturers. This Section does not exclude liability for damage directly caused by a defect in the Software where such liability cannot lawfully be excluded.
13. Age requirements and legal capacity
While browsing and access to the Free Plan basic features are permitted for minors in accordance with the Privacy Policy, subscription to paid plans and entry into the related subscription agreement are reserved exclusively for users who have reached the age of 18, or for minors acting with the explicit involvement, authorization, and supervision of a parent or legal guardian. By proceeding with the use of paid features, the Licensee declares that they have the legal capacity to enter into contracts or that they have obtained parental consent.
14. Governing law and jurisdiction
This EULA is governed by Italian law, without prejudice to any mandatory protections granted to Consumers by the law of the country in which they habitually reside. Any dispute arising from or connected with this agreement shall fall within the jurisdiction of the court of the place of residence or domicile of the Licensee where the Licensee qualifies as a Consumer under applicable law. In all other cases, exclusive jurisdiction shall lie with the Court of Venice, Italy.
15. Changes to this EULA
The Licensor may update this EULA to reflect changes to the Software, legal requirements, security practices, third-party dependencies, or business operations. The updated version will state its effective date and will be made available through the official website or Software. Where a change materially affects the Licensee’s contractual rights or obligations, the Licensor will provide appropriate notice and, where required by applicable law, request renewed acceptance before the change becomes binding. Continued use alone will not waive any mandatory right available to a Consumer.
